Who these terms are for
These terms are an agreement between AutoMotersIndia and the lender or agent (the “Finance Partner”) that creates a finance account. They add to our Terms of Use.
Eligibility and verification
- You must be a bank or non-banking financial company regulated by the Reserve Bank of India, or its duly authorised agent or digital lending partner.
- We may ask for your registration, licence or authorisation, and proof that you may act for the lender, and may refuse or remove an account we cannot verify.
Offers you show
- Show real, current offers: the rate, the tenure, processing and other fees, the annual percentage rate and the key terms, as the Reserve Bank of India’s rules on digital lending and fair practice require.
- Do not guarantee approval in a way you cannot keep, and do not use misleading words such as “instant” or “zero cost” unless they are true.
- Keep your offers up to date. We may hide an offer that is out of date or wrong.
Buyer data
You receive a buyer’s details only when the buyer has asked for finance and agreed to share them. Use them only to respond to that request, collect only what you need and keep them as the Digital Personal Data Protection Act, 2023 and the Reserve Bank’s rules require. Do not sell or reuse them for other products without the buyer’s separate consent.
Loans are between you and the buyer
You alone decide on credit, run your own checks and issue your own loan agreement and key facts statement. We do not underwrite, disburse, collect or recover, and we are not a guarantor.
Fees
Any fee for the placement of offers or for leads is set out in your dashboard or in a separate order. GST is charged where it applies and invoices are issued. Payments follow Payments, Credits and Refunds.
Conduct and complaints
Treat buyers fairly and handle their complaints under your own grievance process. We may share a complaint about you with you and may pause your offers while it is looked into.
Ending, liability and law
Either of us may end this agreement by giving notice, and we may pause or end it at once for breach or for a legal reason. To the extent the law allows, our liability is limited to the fees you paid us for the service that gave rise to the claim. These terms are governed by the laws of India and disputes are subject to the competent courts in India.
